Interesting Psak Beit Din about a dispute regarding the right of using a Chatzer Hashutafin (a jointly owned yard) in Safed – hand-signed by Rabbi Shmuel Heller Av Beit Din of Safed – Safed, 1879.
The Psak Din describes in detail the parties’ rights of using the yard: "אולם בחצר היא אינה רשאה להעמיד טריבוניק מחביות של עץ כי אם דווקא טריבוניק של חביות מחרס הנהוג מזמן רב…. כ"א בכל עת שירצו לטלטל ממקום למקום.. בעת שירצה הרי"ב לשמש בחצר יכול לטלטל החביות מחרס…". Anyone touring the ancient alleys of Safed can easlity understand the importance attributed to every piece of land in yards and houses…
The Psak Din is signed twice by teh Gaon Rabbi Shmuel Heller and the Dayanim of his Beit Din. It should be noted that this document is from when he was approx. 93 years old!, five years before he passed away at the ripe old age of 98.
