Lot 39:
Zichron Eidut – for selling the inheritance rights of a house in Safed – signed by the Dayanim of Badatz Ashkenazim of Jerusalem during the Turkish Empire – 1895 – Pre-HaEidah HaChareidit Era.
The document is signed by the two witnesses Rabbi Gedalya Yoffe and Rabbi Feivel Shmesh. The content is quite simple: the sale of the inheritance rights of Mrs. Alte Sarah Leah of Safed; however it includes complex halachic formulas to avoid conmplications… "מאחר שרציתי מרצון נפשי הטוב, שלא באונס והכרח כלל… הודאה שרירא וקימא דלא למהדר ביה מיומא דנן ולעולם…".
To confirm the witnesses’ signatures, the Dayanim of the Ashkenazic Beit Din at Churvat Rabbi Yehuda HaChassid signed the document as well.
The Gaon Rabbi Chaim Yaakov Shapira of Kovno (1832-1908) served as a Dayan of the Beit Din of Maran Rabbi Yitzchak Elchanan Spektor. In 1891, immigrated to Eretz Yisrael, where he served as a Dayan of the Priushim Beit Din and eventually served as Av Beit Din of the Ashkenazic (Prushim) Beit Din. Was the in-law of Rabbi Aryeh Levin and Rabbi Zvi Pesach Frank, the Rav of Jerusalem.
The Gaon Rabbi Shaul Elchanan Yoffe (passed away in 1904) the son of Rabbi Avraham, Dayan of the Prushim Beit Din.
The Gaon Rabbi Zevulun Hirschson of Bialystok (passed away in 1897) in his old age, immigrated to Eretz Yisrael where he served for several years as Dayan of the Prushim Beit Din.
