"סכסוכים ודיני תורה… השביעי המכריע יהיה…. הרה"ג חיים עוזר גרדזינסקי שליט"א", lengthy and detailed agreement between the opposing committees of Jerusalem. Signed by the Dayanim of HaEdah HaChareidit and the Dayanim of the Beit Din of the Rabbinate headed by Chief Rabbi, Rabbi Avraham Yitzchak Hacohen Kook – Jerusalem, 1931. 

Background: The HaEdah HaChareidit and the Chief Rabbinate were established almost simultaneously with the British occupation of Eretz Yisrael and the demand of the new government for official communities. Both communities were led by great rabbis and both communities established Batei Din, marriage registration, Kashrut and Shechita committees and more. There was a bitter controversy over the Kashruth of the Shechita, each of the parties making an effort to convince more and more butcher shops to use its Shechita, causing anguish among the rabbis of Jerusalem.

This historical agreement was intended to put an end to the controversy and settle the dispute between the two parties. The agreement includes four leaves, 17 complex clauses pertaining to the territories and incomes of the Shechita committees. The agreement begins with the reassuring clause: "שתי השחיטות נשארות נפרדות, כל אחת ברשות עצמה, בכל הנוגע לעצם השחיטה ולכל הנהלתה הפנימית" (both Shechitot remain separate, each one for itself, with all that is related to the Shechita itself and its self-management). Then there are several clauses trying to predict all possible situations. Then there is a clause determining the arbitrators in case of dispute: "סכסוכים ודו"ד אם יתעוררו בין הצדדים… יתבררו על ידי חבר רבנים של שלשה שלשה מכל צד, השביעי המכריע יהיה אחד משני הרבנים האלה: הרה"ג חיים עוזר גרדזינסקי שליט"א והרה"ג משה קליערס שליט"א".

The letter is signed by the Shechitah committee of HaEdah HaChareidit and the Shechitah Committee of the Ashkenazic city committee (the Chief Rabbinate). 

Appearing on verso of the leaf is the signature of Maran Rabbi Avraham Yitzchak Hacohen Kook.


A unique, historical document that was written approx. a century ago yet its content is still relevant "בימים ההם בזמן הזה".
